Quite simple darlin, it looks like courts are trying to step in and do the army's duty, and the army said, "so what"?

I mean, seriously, should we have tried every single prisoner caught on a battle field in court? It is neither reasonable or judicious.

Problem is that, by the Pentagon's own admittance, only about 5% of those detained were picked up on a battlefield. Then we have the trouble from things like this, where people were detained for two years without a crime and then just sent away.

EDIT: Slight misreading of your post / thoughts, but the point stands that the situation down there is really, really poor.
