I want to take some of tom's work of flora, trace, etc... to make some covers for my own text book ONLY, I won't claim the artwork as my own and I'll try to make it obvious that it is his work, i might also want to photoshop it to make it look better... but is this wrong?

P.S. still can't get computer back.... :(

Well, assuming you get permission from Tom in the first place, and then have the copyright info all on the front cover, then no, it is not illegal. But this is probably something you should have asked Tom in the first place.

For making a cover for your own textbook? I can't think of any real reason why you couldn't. I believe that since it's just personal use there's nothing wrong with it. And even if there was, knowing Tom he wouldn't have a problem with it. I might be wrong though.

Quote from the website of copyrights :
Quote:
Could I be sued for using somebody else's work? How about quotes or samples?
If you use a copyrighted work without authorization, the owner may be entitled to bring an infringement action against you. There are circumstances under the fair use doctrine where a quote or a sample may be used without permission. However, in cases of doubt, the Copyright Office recommends that permission be obtained.

In the fair use part that's what I saw

Quote:
the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;

The only thing you need to remember is that you can't use a copyrighted thing to a commercial use or for something that will profit a school. If the cover for your textbook isn't for money, then you can.

I mean, if every girl in my school had to wait to print (that had a copyright on it) a photo of her idol to put it on their textbook, the people that took that photo would only say "yes", for them to print that photo, all day. Hope I could sort some things out.

Technically the fair use term - "For personal use only" can be viewed as - "only you use it and no one else" which can lead to - if anyone else can see it - it is no longer personal use. I cant legally make a T-shirt of Mickey Mouse and wear it around town - but i could make it and wear it around my house.

But honestly no one is going to care unless you attempt to sell it or to give it away.

As long as you dont claim it as your own and don't make them for your friends or sell them - yada yada- I'm 99.8% sure that Tom doesn't mind. that last .2% included .1 - being Tom just wants to make me wrong and decides he doesn't want to allow it - and the other .1 is Tom suddenly being controlled by the ghost of Hitler and decides only blond hair blue eyed people can use his work in this way...

i think it's best that i don't... i'm sure trace, flora or tom would not want me to break any rules even if it is to show my fanship to the comic.

but it would be so cool if i could... sigh. dont worry, i wont use the artwork.

As Sage said, there is no problem. Its for your own textbook, you are not making money off it, its free advertising for Tom, if you asked him, he *will* say yes. I say print it now, do what you want, and ask Tom, then if he says no, you would have to take it down, but as he wont do that, there should be no problem. :wink:

p.s. I wonder if Tom would mind if I print the entire archive to stick in a binder for my own use...
